TERMS OF SERVICE: ATHLETE DEVELOPMENT SOLUTIONS (ADS)
Last Updated: March 2026
By accessing the website https://www.athletedevelopmentsolutions.com/ and purchasing any digital programs (the "Programs"), you (the "User" or "Athlete") agree to the following terms and conditions.
1. NO MEDICAL ADVICE OR CLINICAL RELATIONSHIP
Athlete Development Solutions is a performance education company, not a medical practice.
-
No Doctor-Patient Relationship: While our programs are developed by licensed Physical Therapists (DPT) and Certified Athletic Trainers (ATC), they are acting solely as Performance Consultants and Strength & Conditioning Specialists. Use of these Programs does not create a patient-provider or clinical relationship between you and any member of the ADS staff.
-
Informational Purposes Only: All content—including videos, PDFs, and training templates—is for educational and performance-enhancement purposes only. It is not intended to diagnose, treat, cure, or prevent any medical condition or injury.
2. MANDATORY MEDICAL CLEARANCE
You should consult with a licensed physician (MD/DO) before beginning any high-intensity strength and conditioning or mobility program. By using these Programs, you represent that you are in good physical health and have no known medical conditions that would make athletic training unsafe.
3. ASSUMPTION OF RISK
Athletic training, sprinting, and throwing are inherently dangerous activities. By purchasing these Programs, you voluntarily assume all risks associated with physical exercise, including but not limited to:
-
Musculoskeletal injuries (strains, tears, fractures).
-
Cardiovascular incidents.
-
Injuries resulting from improper equipment use or environmental factors.
-
Potential "overuse" injuries related to high-volume athletic training.
4. RELEASE OF LIABILITY & WAIVER
To the maximum extent permitted by law, you hereby release, waive, and forever discharge Athlete Development Solutions, its owners, developers (PTs/ATCs), and contractors from any and all claims, liabilities, or demands for personal injury, property damage, or wrongful death arising out of your participation in the Programs. This applies even if the injury is caused by the alleged negligence of ADS or its developers.
5. PARENTAL CONSENT & INDEMNIFICATION (High School Athletes)
This section applies to all athletes under the age of 18 (the "Minor Athlete"). If you are a minor, you may only use the Programs with the direct consent and supervision of a parent or legal guardian.
By purchasing the Programs for a Minor Athlete, the parent or guardian agrees to the following:
-
Representation: I represent that I am the parent or legal guardian of the minor athlete for whom I am purchasing this program. I have reviewed these entire Terms of Service with the minor.
-
Supervision: I accept full responsibility for supervising the minor’s training and use of ADS materials.
-
Indemnification & Hold Harmless: To the fullest extent permitted by law, I hereby agree to indemnify, defend, and hold harmless Athlete Development Solutions, its owners, and developers from any and all claims, demands, losses, or legal fees arising from the minor’s use of the Programs. This includes claims of negligence and applies even if the minor athlete himself/herself, or a third party, brings a lawsuit for injuries allegedly sustained during the program.
6. NO GUARANTEE OF RESULTS
ADS provides the tools for athletic improvement, but performance outcomes (e.g., increased velocity, sprint speed, or vertical leap) depend on individual effort, genetics, and adherence. ADS makes no guarantees or warranties regarding specific performance milestones or "injury prevention."
7. INTELLECTUAL PROPERTY & USE LIMITS
-
Single User License: Your purchase grants you a personal, non-exclusive license to use the Program.
-
Prohibited Sharing: You may not share, sell, or redistribute our PDFs, videos, or portal login credentials. Unauthorized distribution of ADS content is a violation of federal copyright law and will result in immediate termination of access without a refund.
8. GOVERNING LAW & ARBITRATION
Any dispute arising from these Terms or the use of ADS Programs shall be governed by the laws of [Your State]. You agree that any legal claim will be settled through binding arbitration rather than in a court of law.
