APP TERMS & CONDITIONS — ATHLETE DEVELOPMENT SOLUTIONS (ADS) ATHLETE APP & COACH PORTAL

Scope: These Terms & Conditions govern account registration, use, and electronic communications (including SMS text messages) for the ADS Athlete App and ADS Coach Portal only (together, "the App"). They do not cover the marketing website at athletedevelopmentsolutions.com, which operates under its own Terms & Conditions, or the physical training liability waiver required separately before starting any training program, available at our Terms of Service & Liability Waiver. By creating an account on the App, you agree to these Terms.

1. ELIGIBILITY & ACCOUNT REGISTRATION

The App is intended for use by athletes, coaches, and parents/guardians who are United States residents. Athletes must be at least 13 years old. Athletes under 18 must be enrolled by their coach, and athletes aged 13–17 require parental or legal guardian consent — confirmed via a secure link sent to the parent/guardian, described in Section 2 below — before their account can be used. No account is created for, or knowingly accepts registration from, anyone under 13.

2. SMS & TEXT MESSAGE COMMUNICATIONS

Consent to Receive Texts. When a coach enrolls a minor athlete (ages 13–17) in an ADS training program, the parent or legal guardian's mobile phone number provided during enrollment is used to send a one-time parental-consent text message. By providing that number, the parent or legal guardian expressly consents to receive this and related transactional text messages from ADS, including:

The initial parental-consent request, containing a secure link to review and confirm consent for their child's account.
One or more follow-up reminder texts, sent only if the athlete requests a resend because the first message wasn't received or acted on.
Account security alerts related to the parent/guardian's own consent confirmation.

No Other Messages. ADS does not send marketing, promotional, or newsletter text messages through this program. No message is sent to anyone who has not been enrolled through this coach-initiated process.

Not a Condition of Purchase. Consent to receive these text messages is not a condition of any purchase or program enrollment.

Message Frequency & Rates. Message frequency varies based on account activity — typically an initial consent request, plus a reminder if the athlete requests a resend. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt-Out & Help. Reply STOP at any time to opt out of future text messages. Reply HELP for help, or contact us at [email protected].

No Third-Party Sharing. Mobile phone numbers and SMS consent collected through this program are never sold, rented, or shared with third parties for their own marketing purposes. See our Privacy Policy for full detail on how this information is collected, used, and protected.

3. PRIVACY

Your use of the App is also governed by our Privacy Policy, which describes what information the App collects, how it's used, and the rights available to athletes, parents/guardians, and coaches. The Privacy Policy is incorporated into these Terms by reference.

4. ACCOUNT SECURITY & ACCEPTABLE USE

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree not to misuse the App, attempt to access accounts or data that aren't yours, or interfere with the App's normal operation.

5. INTELLECTUAL PROPERTY

The App, including its software, design, and content, is the property of Athlete Development Solutions, LLC. You're granted a personal, non-exclusive, non-transferable license to use the App for its intended purpose. You may not copy, modify, reverse-engineer, or redistribute any part of the App without written authorization.

6. SERVICE AVAILABILITY

The App is provided on an "AS IS" and "AS AVAILABLE" basis. ADS does not warrant that the App will be uninterrupted or error-free, and is not liable for temporary downtime, maintenance, or data loss due to technical issues.

7. RELATIONSHIP TO OTHER ADS TERMS

These Terms cover App account registration, use, and electronic communications only. They do not include, and are not a substitute for, the assumption-of-risk and liability waiver required before participating in any ADS physical training program — see our Terms of Service & Liability Waiver for those terms. Use of the general marketing website at athletedevelopmentsolutions.com is separately governed by its own Terms & Conditions.

8. CHANGES TO THESE TERMS

We may update these Terms to reflect App changes or legal requirements. Updates will be published with a revised "Last Updated" date above. For material changes affecting minor athletes' accounts, we'll notify the parent/guardian email on file before the change takes effect.

9. GOVERNING LAW

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved through confidential mediation or binding arbitration in Indiana.
